Welcome to Monovant! We are pleased to offer our watches and strive to provide you with an excellent online shopping experience. This page outlines our General Conditions of Sale ("GCS") applicable to all Monovant watches (collectively, the "Watches"; individually, the "Watch"). Certain collections may also include "Digital Twins" or "Twins," which are virtual replicas of the physical Watch.
1. Application of General Conditions of Sale
These General Conditions of Sale (the "GCS") govern all services, orders, and shipments of Monovant branded Watches, including those sold with associated Digital Twins, that you, as the client (the "Client" or "you"), order from Monovant SP., a sole proprietorship with its registered office at Vakchou 19, 14122, Athens, Greece VAT : 175438148, GEMI: 172086603000 (the "Seller" or "Monovant"), via its website monovant.com (the "Site"). By placing an order, you acknowledge that you have read, understood, and accepted these GCS without reservation. Monovant reserves the right to amend these GCS at any time by publishing an updated version on the Site. Any order placed or product delivered to the Client after the publication of a new version of the GCS on the Site shall constitute acceptance of the amended GCS. By using the Site, you further agree to be bound by its Terms of Use and our Privacy Notice, which we encourage you to read carefully. 2. Product Availability and Description
We offer our Watches for sale on the Site subject to available stock. Photographs and texts illustrating and describing the products on our Site are non-contractual and are provided for informational purposes only. As many of our Watches are unique, often crafted from natural stones with irregular inclusions, the dials may vary slightly from the product images displayed on the Site. Monovant assumes no liability for any errors or omissions in the photographs or texts appearing on the Site. For the avoidance of doubt, the provisions in this Article 2, and generally within these GCS, apply to the sale of Watches both with and without their associated Digital Twins.
3. Pricing, Taxes, and Duties
All prices displayed on the product pages of the Site exclude VAT and shipping costs, unless explicitly stated otherwise. The final price of your Watch, inclusive of applicable costs, will be indicated on the Site's checkout page after you have provided all required information, including your shipping address. Upon your agreement with the displayed final price and completion of payment, we will send you an email receipt. Please note that prices may be subject to change due to currency fluctuations between the time you initially view a product and the time of payment. Monovant is not responsible for any price increases arising from such fluctuations and shall not be liable for any perceived "extra charges." Taxes and customs duties are not included in the online displayed price and are the responsibility of the Client.
4. Retention of Title and Transfer of Risk
Monovant retains full ownership of the products until the complete purchase amount has been paid by the Client.
5. Delivery
Your order will be delivered to the shipping address you provide, contingent upon our ability to deliver to the specified country. Monovant reserves the right, at its sole discretion, to refuse an order, particularly if logistical or legal restrictions prevent shipment to a specific country. If delivery is unsuccessful, the goods will be returned to Monovant. The Client will be responsible for any additional transport costs and other expenses associated with a subsequent delivery attempt. Monovant is not liable for any damage, loss, or mishandling of the package during transit. 6. Returns and Condition of Returned Goods
We will conduct a thorough examination of any returned Watch. We reserve the right to refuse any Watch that shows signs of wear, tear, or any modification from its original condition. Particular attention will be given to the straps, which must be in perfect, resalable condition. The same standards for condition and originality apply to any associated Digital Twins, to the extent applicable to their nature.
7. Warranty and Servicing
All Monovant Watches are manufactured with the utmost care by highly qualified watchmakers, adhering to strict quality standards. Should your Watch require servicing under warranty, please refer to the guarantee section on our Site. Only Monovant is authorized to provide guarantee services; this authorization does not extend to our distributors.
8. Client Breach and Digital Twin License
You acknowledge and agree that if you breach these GCS, Monovant, in addition to any other remedies available at law or in equity, may immediately terminate any license granted to you for the Digital Twin(s) without notice. To the maximum extent permitted by applicable mandatory laws, you will be responsible for reimbursing Monovant for any damages, costs, and expenses arising out of or in connection with your breach of these GCS. You acknowledge the innovative and experimental nature of the issuance and use of Digital Twins. Consequently, Monovant shall have no liability to you for any loss of profit, loss of business, business interruption, loss of business opportunity, or any negative or adverse consequences related to your ownership, display, transfer, or any other use of these Digital Twins.
9. Use of Digital Twins
You are exclusively responsible for your actions while accessing or using the Digital Twins and for any outcomes resulting therefrom. You agree to use the Digital Twins only for lawful and proper purposes, in accordance with these GCS and any applicable laws or regulations. Specifically, you may not, nor allow any third party to: (i) distribute viruses, worms, defects, Trojan horses, corrupted files, hoaxes, or any destructive or harmful code; (ii) send, upload, distribute, or disseminate any unlawful, defamatory, harassing, abusive, fraudulent, hateful, violent, obscene, or otherwise objectionable content; (iii) impersonate another person; (iv) upload or otherwise make available content that infringes the intellectual property rights of others or otherwise violates their legal rights; (v) engage in, promote, or encourage unlawful acts; (vi) upload, post, transmit, or otherwise make available through the Digital Twins application any content that infringes the intellectual property or proprietary rights of any party or otherwise violates the legal rights of others; (vii) engage in, promote, or encourage illegal activity (including, without limitation, money laundering); (viii) interfere with other users' enjoyment or use of the Digital Twins; (ix) use the Digital Twins for any unauthorized commercial purpose; (x) modify, adapt, translate, or reverse engineer any portion of the Digital Twins; (xi) remove any copyright, trademark, or other proprietary rights notices contained in or on the Site or any part of it related to the Digital Twins; (xii) use any technology to collect information about the Site for any unauthorized purpose; (xiii) access or use the Digital Twins for the purpose of creating a product or service that is competitive with any of Monovant's products or services. Furthermore, to the maximum extent permitted, the Digital Twins and any associated artwork are provided "as is," without any guarantee, representation, or warranty by Monovant. Monovant disclaims all implied warranties, including but not limited to merchantability and fitness for a particular purpose, except where such obligations cannot be excluded by law. Monovant assumes no responsibility for the Digital Twins once they have been successfully transferred to the Client's designated wallet address.

11. Right of Withdrawal
Except under exceptional circumstances expressly agreed to by Monovant, or as otherwise mandated by applicable law, the Client is entitled to a right of withdrawal within 14 days from the purchase.
12. Miscellaneous
Force Majeure and Liability Exclusions: Monovant shall not be liable for delays caused by events beyond its reasonable control, including but not limited to acts of force majeure (such as epidemics, pandemics, traffic congestion, wars, geopolitical crises, extreme weather conditions, or detention of goods by customs or public authorities) or significant technological issues (such as losses attributable to the utilized blockchain network, its features, or any linked wallet). Such events do not entitle the Client to withdraw from the purchase contract or claim compensation from Monovant for any resulting damage or delay.
Limited Liability: Without prejudice to the scope of these GCS where specific liability limitations may apply, no claim whatsoever relating to the products delivered, non-delivery of products, or any other claim shall exceed the purchase price of the goods in question.
Applicable Law: These GCS are governed by and construed in accordance with the laws of Greece (Hellenic Republic).
